Terms of Use
In effect from 16 October 2026.
1. About these terms
These Terms of Use (the “Terms”) are an agreement between you and Trust Aboki, a company registered in Nigeria (“Trust Aboki”, “we”, “us”). They apply when you visit the Trust Aboki website, create an account or use any of our services (the “Service”). Our Privacy Notice explains how we handle personal data and forms part of these Terms.
By ticking the box when you create an account, or by using the Service, you accept these Terms. If you do not accept them, do not use the Service. You must be at least 18 years old and able to enter into a binding contract under Nigerian law. If you use the Service for a business, you confirm you are authorised to bind it, and “you” includes that business.
2. What Trust Aboki is, and what it is not
Trust Aboki is an information and introduction service. It shows exchange-rate information, lists bureaux de change (“BDCs”) whose licence we have checked, and lets customers ask BDCs for offers, compare them, agree terms and keep a record of what each side says happened.
- We are not a BDC, bank, payment service or money transmitter. We do not buy, sell or exchange currency, and we do not quote rates in our own name.
- We never hold your money. We do not receive, hold, transfer, escrow, release or refund any naira or foreign currency. There are no wallets or balances on Trust Aboki. You pay, and are paid by, the BDC directly at its branch.
- We are not a party to any exchange. An agreement made through the Service is a contract between the customer and the BDC alone. We record its terms; we do not guarantee that either side performs it.
- We are not licensed or endorsed by the Central Bank of Nigeria (CBN) or any other regulator. “Licence checked” means we compared a BDC’s licence details with the CBN’s published list on the date shown. It is not a guarantee of the BDC’s conduct, solvency or rates.
- Nothing on the Service is financial, investment, tax or legal advice.
3. Your account
- Give accurate information and keep it up to date. One person, one account.
- Keep your password and any sign-in codes secret. You are responsible for what happens under your account until you tell us it has been compromised. We will never ask for your password, BVN, card PIN or one-time code.
- We may ask you to confirm your email address, phone number or other details, and may refuse or close an account where we reasonably suspect false information, fraud or a breach of these Terms.
4. Customers
- Post only genuine requests you intend to complete, for a lawful purpose that you state truthfully. Requests are for individuals’ personal needs, not for businesses’ import or trade transactions.
- You remain responsible for complying with Nigerian foreign-exchange law and the limits and documentation that apply to you. The BDC will carry out its own identity and documentation checks and may refuse to deal with you.
- Do not split a transaction, use another person’s identity, or otherwise try to avoid limits, checks or reporting obligations.
- Never pay a “deposit”, “commitment fee” or any money before you are at the BDC’s branch. Pay only at the licensed premises or to the BDC’s own business account.
5. BDCs
If you use the Service for a BDC, you also confirm and agree that:
- the BDC holds a valid CBN licence for the business it does through the Service, and you will tell us at once if that licence is suspended, revoked, expires or changes;
- every rate you post and every offer you send is genuine, made in the licensed entity’s name, and honoured for the time you state;
- you trade only at your licensed premises, comply with the CBN’s guidelines for BDCs and with anti-money-laundering and counter-terrorist-financing law (including customer due diligence, record keeping and reporting), and that these duties remain yours alone;
- you will not use customers’ details for any purpose other than the exchange they asked for; and
- you will indemnify Trust Aboki against claims, losses, fines and costs arising from your exchanges, your breach of these Terms or of the law, or information you give us.
Our licence check, listing or verification badges do not relieve a BDC of any legal or regulatory obligation.
6. Offers, agreements and settlement
- An offer states the rate, amount, how it will be settled and how long it is held. When a customer accepts an offer, the Service records the agreed terms. Those recorded terms are not changed afterwards, even if rates move.
- The customer and the BDC settle directly with each other, at the BDC’s branch. We play no part in the payment and cannot stop, reverse or recover one.
- Each side can report whether the exchange happened. An exchange is shown as completed when both say so, or as our published rules describe. These records are for the parties’ convenience and for marketplace oversight; they are not receipts or proof of payment.
- Photos, screenshots or PDFs shared in a conversation are not checked by us and can be edited. Rely only on what you see in your own account or at the counter.
7. Problems between customers and BDCs
If something goes wrong, report it through the Service. Our staff may review what both sides recorded and decide how the exchange is shown on the Service and whether to limit an account. A report is not treated as proof on its own. Our decisions concern the Service only: we are not a court or arbitrator between you, we do not decide who owes whom money, and we are not obliged to resolve your dispute. You keep every legal right and remedy you have against the other party.
8. Rules for everyone
You must not use the Service to:
- commit or attempt fraud, money laundering, terrorist financing or any other offence, or deal with sanctioned persons;
- impersonate any person, BDC, regulator or Trust Aboki staff, or ask anyone for a password, PIN, one-time code or advance payment;
- trade currency without a licence, offer cryptocurrency, or arrange exchanges away from licensed premises;
- post false rates, false reviews or misleading information;
- harass, threaten or discriminate against anyone;
- copy, scrape or resell the Service or its data in bulk, except through the published public data API and its usage limits; or
- interfere with the Service’s security or operation, probe for vulnerabilities without our written permission, or get round any limit or restriction.
9. Your content and reviews
You keep ownership of what you post. You give us a non-exclusive, royalty-free licence to host, display, moderate and use it to run, protect and improve the Service, for as long as we keep it under our retention schedule. Reviews must reflect your own genuine experience of an exchange. We may remove content that breaks these Terms or the law.
10. Rates and other information
Official rates are published by the CBN and shown for reference only; a BDC’s rate will differ. Rates posted by BDCs are theirs and can change. Calculator results are estimates. We show the source and date of every figure and work to keep information accurate, but we do not guarantee that any information is complete, current or error-free, or that the Service will always be available.
11. Suspension, restriction and closure
We may restrict, suspend or close an account, remove a listing or withhold a feature where we reasonably believe it is needed to comply with law or a lawful request from an authority, to protect users or the Service, or because of a breach of these Terms. Where the law and safety allow, we will tell you why, and you can appeal through the Service; a different staff member decides the appeal. You may close your account at any time from your settings. Sections 2, 5 (indemnity), 6, 7 and 12–16 survive closure.
12. Fees
The Service is currently free for customers and BDCs. We will give at least 30 days’ notice before introducing any charge, and nothing is charged without your agreement.
13. Our intellectual property
The Trust Aboki name, logo, software, design and content we create belong to us or our licensors. You may use the Service for its intended purpose only.
14. Limits on our responsibility
The Service is provided “as is” and “as available”. To the fullest extent Nigerian law allows:
- we are not responsible for the acts, omissions, rates, conduct, solvency or legal compliance of any BDC or customer, or for any exchange, payment or loss of money between them;
- we are not liable for indirect or consequential loss, or for loss of profit, business, opportunity or data; and
- our total liability to you for all claims connected with the Service in any 12 months is limited to the higher of the fees you paid us in that period and ₦100,000.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud, for death or personal injury caused by negligence, or any right you have as a consumer under the Federal Competition and Consumer Protection Act 2018 or the Nigeria Data Protection Act 2023.
15. Your indemnity
You agree to indemnify us, our staff and officers against claims, losses and reasonable costs (including legal fees) caused by your breach of these Terms or of the law, or by your dealings with another user, except to the extent caused by our own breach or negligence.
16. Law and disputes with us
These Terms are governed by the laws of the Federal Republic of Nigeria. If you have a complaint about us, contact us first at legal@trustaboki.com; we will try to resolve it within 30 days. A dispute not resolved in that time shall be referred to arbitration under the Arbitration and Mediation Act 2023 before a sole arbitrator, seated in Lagos and conducted in English. This does not stop either of us seeking urgent relief from a court of competent jurisdiction in Nigeria, and it does not affect your right to complain to the Federal Competition and Consumer Protection Commission, the Nigeria Data Protection Commission or another authority.
17. Changes and general terms
- We may change the Service or these Terms. For a material change to these Terms we will give account holders at least 14 days’ notice by email or in the Service, unless a change is required sooner by law or for security. Continuing to use the Service after a change takes effect means you accept it; if you do not, close your account.
- We are not responsible for failures caused by events beyond our reasonable control, such as outages of networks, power, hosting or data sources, or acts of authorities.
- You agree that notices, records and agreements may be made electronically and that electronic records kept by the Service may be used as evidence.
- If a court or arbitrator finds part of these Terms invalid, the rest remains in force. A delay in enforcing a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor running the Service. These Terms, with the Privacy Notice, are the whole agreement between you and us about the Service.
